A revival of rental right to software? Microsoft's new controversial licensing practices

Abstract

The article discusses the rental right licences as newly introduced by Microsoft. The issue is of great importance. Currently, Microsoft is "testing" enforcement of these licences in Korea and is likely to initiate similar claims in Europe. This article examines the relationship between Microsoft’s rental right licences and exclusive rental rights to software as granted under international and EU copyright laws.
