Challenging age discrimination in Australian workplaces: from anti-discrimination legislation to industrial regulation

Abstract

The anti-discrimination legislation, the Age Discrimination Act 2004 (Cth) (ADA) does not appear to have been effective in Australia in curbing age discrimination against mature age workers in the workplace. New provisions introduced under the Fair Work Act 2009 (Cth) (FWA) provide an alternative means of challenging workplace age discrimination in the federal industrial jurisdiction.
