Abstract

Democracy, pillar of Latin American countries and cornerstone of their Constitutions, is in risk because of presidencialism, constitutionality and Welfare State. This one is the aspect that most concerns the author because, even though Democracy Constitution establishes equality, justice and social rights in general, their effective protection is beyond by current changes, international economy and pace of globalization. As a solution to this problem, Constitutional Tribunal has played an essential role supporting social rights without concern of the State Structure or the economic plan.
