    Abstract

    Discretionary sections in the Evidence Acts are many and varied - ranging from guided to unguided - adherence to the statutory scheme and not the prior common law is a mater that advocates and judicial officers alike need to be conscious of at all times - whether the case is in a civil or criminal jurisdiction.
