Abstract
A recent innovative challenge by the Federated States of Micronesia ('FSM') to the renovation of Prunéřov II, a large, coal-fired power station in the Czech Republic, raises important questions as to the potential for transboundary pollution law to address climate change. Despite a clever strategy that gave FSM a seat at the consultative table, the peculiarity of Czech law limits the relevance of this challenge to other jurisdictions.
