Getting away with non-compliance: review under Schengen

Research output: Chapter in Book/Report/Conference proceeding › Chapter › peer-review

Abstract

This chapter engages with possibilities for review in respect of possible or alleged violations under the Schengen Agreement (Schengen I - Absence of border controls). It compares the previous Schengen Agreement, the current Schengen structure and the reform proposals via the Lisbon Treaty. The chapter concludes that "review" is mostly ex ante at the gate (i.e. procedures to review State compliance before they are able to access the Schengen area), but that there are few practical options for ex post review in respect of both States and relevant European Agencies.
