Human rights within the family – horizontal effect and positive obligations

Abstract

The family has long been exempt from legal intervention based on human rights protection. These days, the concepts of horizontal effect (drittwirkung) and positive obligations have, however, changed the legal landscape. This paper looks at the existence and potential of horizontal effect and positive obligations under the major human rights instruments. It concludes that positive obligations have been universally embraced and that, moreover, there is a move towards the acceptance of horizontal effect allowing for the applicability of human rights within the family.
