Abstract
Explains Hans Kelsen's late revision of his Grundnorm (basic norm) concept as fictional. Shows how this revision makes sense in an unsuspected 'outsider' dimension to his Pure Theory of Law. Develops from that a new type of concept of law, committed to social-scientific independence of cognition. Forms a pair with article "Han Kelsen, Legal Scientist" (2023).
