Nationality as reparation? The Case 002/02 trial judgment at the Extraordinary Chambers in the Courts of Cambodia

Abstract

This case note discusses a reparation request for access to or recognition of Cambodian nationality advanced by minority civil parities in Case 002/02 before the Extraordinary Chambers in the Courts of Cambodia (ECCC). It examines how victims’ lawyers framed the request for the purposes of the ECCC’s distinct reparation mandate, the challenges the request faced at trial and how judges eventually dealt with the request.
