Beginning with an analysis of how this relationship has evolved in fundamental human rights documents, the paper then explores its manifestation in climate change litigation, examining significant cases that exemplify the indivisibility between the two. Furthermore, the Chapter will address essential insights and obstacles drawn from legal precedents, including the challenges of proving causation, the complexities surrounding the application of non-binding language in human rights discourse, and the fundamental issues in addressing climate change impacts within a framework focused on the rights and freedoms of current individuals rather than future generations.
